Government Guarantees of PPPs – draft Bill

The Written Laws (Miscellaneous Amendments) Bill (October 2016) has, amongst other things, draft amendments to the Government, Loans, Guarantees and Grants Act to empower the Minister responsible for Finance to manage guarantees issued to Public Private Partnership Projects in accordance with the Public Private Partnership Act 2010.

However, the current drafting does not expressly enable guarantees of public entity contractual obligations under PPP Agreements, but rather continues to refer to guarantees of loans to public entities. Comments on the Bill have been requested and it is hoped this issue will be addressed.
